Municipal and Land Use

In addition to acting as counsel to the Towns of Acton, Arundel, Bowdoinham, Brownfield, Newfield, Wells, and others, the municipal attorneys at Bergen & Parkinson have served as special counsel to municipalities throughout the State of Maine in circumstances where we have special expertise in the subject matter or where regular town counsel is unavailable because of a conflict of interest.

All of our team members have argued important land use cases before the State's highest court - - both for and against municipalities.  The members of Bergen & Parkinson's Municipal Practice Group have many years of experience in drafting ordinances, negotiating inter-local agreements, and in charter, labor and personnel matters.

Besides representing municipalities, we have substantial experience representing developers and individual property owners at the local and state level.  Many of these have been high profile matters involving extensive public hearings and subsequent litigation in the court system.

Durward Parkinson has edited a manual widely used by governmental officials on land use issues, and has lectured widely on this subject.

Leah Rachin has authored an article on groundwater law published in the Maine Townsman.
